Art.1 – General

​

The purpose of these general terms and conditions is to govern the contractual relations between the company JTEC Racing, whose registered office is fixed at the following address:

and the Customer defined below as being the user of the website www.jtec-racing.com and accepting these general terms and conditions.

 

All other conditions are binding on JTEC Racing only after written confirmation from it. The information on this website may be modified by the company JTEC Racing without notice. The mere fact of placing an order on the website www.jtec-racing.com implies the unreserved acceptance of these general terms and conditions.

Art.2 – Products

​

The products offered for sale by the seller are those listed on the website, on the day of consultation by the user, within the limits of available stocks.

 

Each product is accompanied by a description established by the seller.

 

The photographs on the website are as faithful as possible but cannot ensure a perfect similarity with the product offered, in particular with regard to the colours. These products and services are offered while stocks last. If, despite his efforts, all or part of the items are unavailable, the seller informs the customer by e-mail as soon as possible and offers him the possibility of choosing between waiting or cancelling the order of unavailable items free of charge. Available items will be delivered as normal.
 

Art.3 – Price

​

The prices are indicated in Euros (€), valid in all the countries of the Euro zone and are understood, excluding shipping costs. They can be modified at any time and without notice.

 

They take into account any reductions as well as VAT, applicable on the day of the order. The prices charged are those applied at the time of the order within the limits of available stocks and subject to typographical errors.

 

Shipping costs are calculated based on the nature of the items ordered and the carrier. The shipping costs are specified at the end of the selection of the various products by the customer, and are recalled in the summary of the order which precedes the validation.
 

Art.4 - Registration and validation of the order

​

The customer, who wishes to buy a product or a service, must:

  • complete the identification form on which he will indicate all the requested contact details;

  • complete the online order form giving all the references of the products or services chosen;

  • validate his order after checking it;

  • make the payment under the conditions provided;

  • confirm their order and payment.

  • Further information may be requested thereafter to ensure the quality and safety of the delivery.

 

Confirmation of the order implies acceptance of these conditions of sale, the recognition of having full knowledge of them and the waiver of its own conditions of purchase or other conditions.

 

All the data provided and the recorded confirmation will constitute proof of the transaction. Confirmation will be worth signing and acceptance of transactions.

 

Upon registration of the order, an order number is communicated to the customer as well as a confirmation on the screen and/or by e-mail. The data recorded by the company JTEC Racing constitute proof of the nature, content and date of the order.

 

These general terms and conditions and the summary of the order sent to the customer form a contractual whole and constitute all the contractual relations between the parties. In case of contradiction between these documents, the general terms and conditions will prevail.
 

Art.5 - Delivery

​

If the item ordered is available in stock, the order preparation time is 1 to 3 working days after validation of payment, the average shipping time is around 1 to 4 days for Belgium and other EU member countries. In case of out of stock, the replenishment time is approximately 4 weeks. Shipping times will only start from the date of payment of the order.

 

Delivery times are only indicative; if these exceed thirty days from the order, the sales contract may be terminated and the customer reimbursed.

 

Delivery is valid in Europe only. For other countries, it will be necessary to send the seller a request via the contact form in order to quantify the amount of the shipment.

 

The products ordered by the customer will be delivered to the address indicated on the customer's order form, which can only be in the agreed geographic area. The goods are transported at the risk of the seller until delivery of the goods to the delivery address specified by the customer. You must be present during the delivery of the package to allow delivery in the best possible conditions. Transport does not include delivery to floors which remains for the carrier's approval. From that moment on, the customer alone assumes the risks.

 

Upon receipt of the goods, the customer must immediately check their condition and conformity. All complaints relating to a defect in the delivered goods, an inaccuracy in the quantities or an incorrect reference in relation to the order confirmed by the company JTEC Racing, must be made in writing on the delivery slip. If the goods are damaged, it is imperative to refuse the product and state the cause in writing on the delivery slip.

 

In addition, JTEC Racing reserves the right to refuse any order from a customer with whom there is an ongoing dispute.

The seller will not be responsible for the total or partial non-performance of its obligations under this contract, if this non-performance is caused by an event constituting force majeure, in particular the presence of computer viruses, in the event of disruption or total or partial strike, in particular of the postal services and means of transport and / or communications, flood, fire, etc. Events that meet the criteria set by case law will be considered as force majeure.

Art.6 - Right of withdrawal

​

The customer has fourteen calendar days to return the product(s) he ordered at his own expense, without penalty and without giving any reason. This period starts from the day after the delivery of the order. For goods subject to successive deliveries, the withdrawal periods begin to run the day after the day of the last delivery.

 

If you want to return the products as described above, you may only unpack or use them to the extend needed to assess whether or not you wishes to retain them. Returned products may be tested, but not used. When returning the products, you will also have to return all delivered accessories and return the goods in their original condition and packaging as well as taking in account our instructions.

 

This right of withdrawal is not applicable for the professional buyer.

 

If the aforementioned conditions are met, the customer will be reimbursed, within fourteen calendar days of the withdrawal, for the sums he has, if applicable, paid in payment.

 

The customer does not have a right of withdrawal for contracts for the supply of goods made to the customer's specifications or clearly personalized or which, due to their nature, cannot be reshipped or are liable to deteriorate rapidly.

Art.7 – Payment

​

Any order implies a contribution to the shipping costs referred to in Article 3.

We only accept advance payment through our website using the payment methods indicated there. When validating the order, the customer is invited to indicate the number of his credit card or debit card and the expiration date on the order form: payment is then made according to the terms agreed with his bank.

 

In order to guarantee safe online payment and the safety of your personal data, the transaction data will only be wired while encrypted with SSL technology. In order to make payments with SSL no special software is required. You recognize a safe SSL-connection by the “lock” in the bottom status bar of your browser. 

 

The items ordered remain the exclusive property of JTEC Racing until full payment of the order. The transfer of ownership of the products to the customer takes place at the time of full payment of the price.
 

Art.8 - Warranty

​

The customer must keep the delivery slip. If an item does not suit him, he has 14 days to return the goods, provided they are in the same condition as when they were sent. The customer benefits from the legal guarantee for any lack of conformity existing at the time of delivery of his article, if he did not know or was not supposed to know the defect at the time of the conclusion of the contract and if it appears within two years of delivery. In this case, the customer can demand, either the repair of his article, or its replacement and, if none of these solutions is possible, either an adequate reduction of the price or the termination of the contract, under the conditions provided by law. (articles 1649 bis et seq. of the Civil Code). To do this, the customer informs the seller in writing at the latest within two months from the day on which he noticed the defect. If the defect appears within six months of delivery, it is in principle the seller's responsibility to prove that it did not exist at the time of delivery. After the two-year period, the customer can no longer demand the repair or replacement of his item. The costs of preparing and sending the order, as well as the management costs, remain due if the customer asserts his right to return all or part of his order.

 

These general terms and conditions and the contractual relations between the seller and the customer are subject to Belgian law. In the event of a dispute, only the courts of the judicial district of the seller's head office, except for binding public order provisions, are competent.
 

Art.9 - Protection of privacy with regard to the processing of personal data

​

The provision of personal information collected in the context of distance selling is mandatory, this information being necessary for the processing and delivery of orders as well as for preparing invoices. This information is strictly confidential. The lack of information implies the automatic rejection of the order. The customer can have access to this data at any time and apply for its rectification, by sending a letter or an email accompanied by a photocopy of both sides of his identity card. Additional information concerning the protection of privacy with regard to the processing of personal data can be obtained from the Data Protection Authority, rue de la Presse 35 in 1000 Brussels.

 

Art.10 - Intellectual property

​

All elements of the seller's site are and remain the intellectual and exclusive property of the latter.

No one is authorized to reproduce, use, redistribute, or use for any purpose whatsoever, even partially, elements of the site whether they are software, visual or sound.

Any single link or hyperlink is strictly prohibited without the prior express written consent of the seller.

 

Art.11 – Complaints procedure and conflicts

We do hope that all our customers are always 100% satisfied. If nevertheless you would have complaints concerning our services, please do not hesitate to contact us at info@jtec-racing.com. We will do the utmost to deal with your complaint within 7 days.

 

All contracts we conclude with our customers are, regardless of their place of residence, exclusively governed by Belgian law. Only the courts of Belgium are competent to adjudicate with disputes arising out of or connected to these contracts. If as a result of international law the law of a different country applies, the interpretation of the current general terms and conditions will in the first instance be done in accordance to the Belgian Law on Market Practices and Consumer Protection.

 

In case of out of court commercial dispute settlements, the consumer ombudsman of the FPS economy is competent for every demand concerning out of court dispute settlement.
